We’re hard-pressed to think of an industry that has more risk and more unknowns than construction. Construction law is unique in recognizing the need for a flexible contract—one that expects change and seeks to channel and allocate its risks. Construction liens provide contractors with leverage against private property that’s been improved by their work. In public works, contractors have a claim against a bond instead of the public property. Construction liens and bond claims provide the same thing: security for the payment you’ve earned on the work you’ve performed. Liens and bond claims are technical. Success hinges on correctly recording and pursuing the lien or bond claim. Once your lien rights are perfected (i.e., correctly recorded), it's all about strategy. Developing the right strategy and implementing it requires experienced counsel that knows how and when to maximize the leverage that these tools provide.
